Due to Covid-19 pandemic situation the Commission had decided to hear the matter through Video Conferencing in the Virtual Court on 13.07.2021. Accordingly the parties had been intimated.
2. Shri Ashok Kumar Panda and Shri Hitendra Rath, Advocate on behalf of M/s. NBVL, Ms. Sasmita Mohanty, AGM (PP), GRIDCO and Shri P. K. Das, CGM (PP), GRIDCO are present. Nobody is present on behalf of DoE, GoO. The counter reply filed by GRIDCO is taken on record.
3. The case is taken up for hearing on question of admission as well as on merit through video conferencing. During hearing the counsel for the petitioner prays for adjournment of hearing as the petitioner has received the counter reply of GRIDCO yesterday and it has to file its rejoinder to the reply of GRIDCO. The representative of GRIDCO prays to implead SLDC as a party to the present proceeding as it is necessary from scheduling / energy accounting point of view.
4. Prayers of both petitioner and GRIDCO are allowed. SLDC is impleaded as a respondent in this matter. The petitioner is directed to serve the copy of its application on SLDC within three days from today. SLDC is directed to file its reply on or before 20.07.2021 serving copy on the other side. The petitioner is directed to file its rejoinder by 23.07.2021.
5. Post the matter on 27.07.2021 at 11.00 AM for hearing. The registry is directed to issue notice to SLDC for appearance and filing of reply in this matter. No further notice shall be issued to the petitioner & GRIDCO Ltd. in this regard.

2. Shri R. P. Mahapatra, the authorized representative and Shri Ashok Kumar Parida of M/s. NBVL, Ms. Sasmita Patajoshi, AGM (RA), GRIDCO, Shri B. B. Mehta, CLD, SLDC and Ms. Sonali Patnaik, ALO, DoE, GoO are present. The reply of SLDC and GRIDCO are taken on record.
3. The case is taken up for hearing on question of admission as well as on merit through video conferencing. During hearing Shri V. Wagle of TPCODL who was present in another case prayed the Commission to implead all the DISCOMs of Odisha as respondents in the present proceeding as the re-fixation of tariff for procurement of power by GRIDCO from NBVL will affect the DISCOMs.
4. The authorized representative of the petitioner prays for adjournment of hearing as the petitioner has to file its rejoinder to the reply of GRIDCO and SLDC. He also states that the petitioner has no objection regarding impleadment of DISCOMs as respondents to the present proceeding along with other respondents.
5. Prayer of the petitioner for filing of rejoinder to the reply of the respondents is allowed. TPNODL, TPWODL, TPSODL and TPWODL are impleaded as respondents in the present proceeding. The petitioner is directed to serve the copy of its application on TPCODL, TPNODL, TPSODL and TPWODL today through email. The respondents are directed to file their reply by 03.08.2021 serving a copy of the same on the petitioner. The petitioner is directed to file its rejoinder by 10.08.2021 serving a copy of the same on the respondents.

As there are some discrepancies in the numbers submitted by both the petitioner and the respondent GRIDCO, we opine that there should a meeting between the parties in the office of the Commission in presence of Secretary, OERC by 10.11.2021. Therefore, Secretary, OERC is directed to fix the date and time of such meeting with due intimation to the petitioner, GRIDCO and TPCODL.
4. GRIDCO and TPCODL are directed to file their reply to the said minutes of the meeting to be held by 10.11.2021 on or before 17.11.2021 serving a copy of the same on the petitioner. The petitioner is directed to file its rejoinder to the said reply of GRIDCO and TPCODL by 24.11.2021 serving copy of the same on them.
