Due to Covid-19 pandemic situation, the Commission had decided to hear the matter through Video Conferencing and accordingly intimated the same to the parties concerned. 2. Shri Pratap Mohanty of TPNODL, Shri P. K. Dash, CGM(PP) of GRIDCO, Shri B. K. Das, GM, OPTCL and Shri R. P. Mahapatra are present. 3. Shri R. P. Mahapatra states that since the annual business plan matter involves tariff related issues of TPNODL, a public hearing is very much necessary. Therefore, he prays for a public hearing by the Commission while disposing Annual Business Plan application of TPNODL for FY 2021-22. 4. Prayer of Mr. R. P. Mahapatra is allowed. The Registry is directed to issue public notice seeking reply from the Respondents/ public by 21.06.2021 with a copy to the Petitioner. M/s. TPNODL shall file rejoinder by 25.06.2021. 5. 229-Jun-21INTERIMCase Nos. 37, 39 & 40/2021 Interim Order No.1 Date of hearing: 29.06.2021 Date of order:29.06.2021 Due to Covid-19 pandemic situation the Commission had decided to hear the matter through Video Conferencing in the Virtual Court on 29.06.2021. Accordingly the parties were intimated. 2. Shri Gajanan Kale, CEO, and Shri K.C.Nanda, DGM (Fin.), TPWODL, Shri Aravin Singh, CEO and Shri Milind Pravakar Kulkarni, Chief Operation Services of TPSODL, Shri Bhaskar Sarkar, CEO, TPNODL, Shri B. K. Das, Sr. GM (RT & C), OPTCL, Shri Bibhu Charan Swain on behalf of Power Tech Consultant Pvt. Ltd. and UCCI, Shri Ananda Mohapatra, Shri L. K. Mishra, GRIDCO, Ms. Sonali Patnaik, ALO, DoE, GoO are present. The reply filed by OPTCL, UCCI and the rejoinder filed by the petitioner to the said reply of OPTCL and UCCI are taken on record. 3. M/s. TPWODL, TPNODL, & TPSODL have filed their business plan applications for FY 2021-22 seeking approval of the Commission in the above noted cases. These are clubbed together for analogous hearing by the Commission as these are similar in nature. Earlier the Commission had directed for publication of a notice inviting suggestion/objection of general public on the application of Business Plan for FY 2021-22 of the petitioners. 4. Pursuant to the said public notice M/s. UCCI, OPTCL, Shri Ananda Kumar Mohapatra have filed their objections/suggestions serving a copy of the same on the petitioners. 5. The above noted cases are clubbed together and taken up for analogous hearing through video conferencing today. The Petitioners made presentation of their applications. Shri K. C. Nanda, DGM (Fin.), TPWODL states that these applications have been filed basing on the vesting order of the Commission for the Utilities. When the new DISCOMs took over, the tariff proceeding for FY 2021-22 were either under process in the Commission or had been concluded. Therefore, the Commission in their vesting order so also in the tariff order allowed them to make additional submission with regard O&M and A&G expenses for FY 2021-22. Therefore, in effect these applications are extension of ARR applications. They do not seek any tariff re-determination this time. They only want the additional expenditure over and above the expenditure approved by the Commission in their tariff order to be recognized. Shri Ananda Mohapatra states that these applications are not maintainable since those have not been filed as per OERC Tariff Regulation which states that five year business plans should be submitted. He further states that the nomenclature of these applications as Business Plan is erroneous. During hearing the representative of GRIDCO prays for two weeks time for filing of reply. 6. Heard the parties at length. The Commission observes that GRIDCO on behalf of Government of Odisha is holding 49% equity share in each of the DISCOMs. Therefore, any proposal from the DISCOMs for approval of Business Plan for FY 2021-22 should have respective Board's approval. 7. After hearing the parties and going through the case records the Commission directs the petitioners to share their presentations with the respondents. The respondents are directed to file their written note of submission in the above noted cases by 06.07.2021 serving copy of the same on the applicants. The applicants are directed to file their written note of submission separately by 06.7.2021. Since the Government owns a large number of assets executed through different schemes, the Commission directs that the list of those assets alongwith the investment in different DISCOMs be furnished by 15th July, 2021. 8.
