Due to Covid-19 pandemic situation the Commission had decided to hear the matter through Video Conferencing in the Virtual Court on 06.07.2021. Accordingly the parties had been intimated.

3. The case is taken up for hearing on question of admission as well as on merit through video conferencing. During hearing the counsel on behalf of SECI prays for adjournment of hearing and allow them time for filing of their reply. The representative of TPCODL has also prayed for time to file their reply.
4. Prayers of respondents for filing of reply are allowed. The respondents are directed to file their reply by 13.07.2021 serving a copy of the same on the petitioner. GRIDCO and SECI are directed to file their rejoinder to the reply of the DISCOMs by 20.07.2021 serving copy on the other sides.
5. Put up on 27.07.2021 at 11.00 AM for hearing. No further notice shall be issued to the parties concerned in this regard.

2. Ms. Sasmita Pattajoshi, AGM and the Manager (RE), GRIDCO, Shri M. G. Ramachandran, Sr. Advocate on behalf of M/s. SECI, Shri V. Wagle CEO, TPCODL, Shri K. C. Nanda, DGM (Fin.), TPWODL, Ms. Malancha Ghose (RA), TPNODL, Shri Binod Nayak, Asst. GM (Comm.), TPSODL, Ms. Sonali Patnaik, ALO, DoE, GoO and the representative of M/s. GEDCOL are present. The reply filed by TPCODL, TPSODL, TPWODL and TPNODL are taken on record.
3. The case is taken up for hearing through video conferencing. During hearing CEO, TPCODL has raised some issues regarding purchase of power by GRIDCO from M/s. SECI. The representatives of TPNODL and TPSODL have supported the issues raised by TPCODL. The Sr. Counsel appearing on behalf of M/s. SECI has prayed the Commission to direct the DISCOMs of Odisha to serve the copy of their reply on M/s. SECI through email for filing of their rejoinder. He also submits that M/s. SECI supports the application of GRIDCO.
4. Prayer of M/s. SECI for filing of rejoinder is allowed. TPCODL, TPNODL, TPSODL & TPWODL are directed to serve the soft copy of their reply through email to M/s. SECI today. Both GRIDCO & M/s. SECI are directed to file their rejoinder to the reply of the DISCOMs of Odisha along with the issues raised during hearing by 03.08.2021 serving copy on the other side.

GRIDCO is directed to file a separate petition regarding inclusion of compensation clause in the PSA impleading the generators, SECI and the DISCOMs as respondents within seven days i.e. by 31.08.2021 serving copy of the same on the respondents.
